These Terms of Service ("Terms") govern your use of VirtualTourEasy ("VTE", "the Service"), operated by Remarso ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Account Registration

User Liability for Content

You are solely responsible and legally liable for all content you upload, create, or publish on VirtualTourEasy. Remarso is a hosting platform and is not liable for user-generated content. We act as a neutral intermediary and will cooperate fully with law enforcement authorities when required.

3. Content Ownership

Your Content

You retain full ownership of all content you upload to VirtualTourEasy, including images, audio, tour configurations, and any other materials. We do not claim ownership of your content.

By uploading content, you grant us a limited, non-exclusive license to host, store, display, and distribute your content as necessary to provide the Service (e.g., serving your published tours to viewers).

AI-Generated Content

When you use our AI features (photo enhancement, 360° generation, outpainting, text-to-360°), the resulting AI-generated or AI-modified images are yours to use. However:

Lead Data

Data collected through your lead capture forms belongs to you. You are the data controller for any personal data collected from your tour viewers and are responsible for complying with applicable privacy laws (including GDPR) with respect to that data.

4. Plans, Payments, and Billing

Subscription Plans

VirtualTourEasy offers the following plans:

Billing

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Plan Limits

Each plan has specific limits (number of tours, storage, AI credits, team members, etc.). If you exceed your plan limits, you may need to upgrade to continue using certain features. We will notify you before restricting access.

Refunds

Subscriptions can be cancelled at any time. Upon cancellation, you retain access to paid features until the end of your current billing period. We generally do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@virtualtoureasy.com.

5. Service Availability

We strive to keep VirtualTourEasy available and reliable, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to:

If you use team features, the account owner (organization admin) is responsible for managing team member access and ensuring all team members comply with these Terms. The account owner is liable for actions taken by team members within the organization.

You may delete your account at any time. This will cancel any active subscription and schedule your data for deletion within 30 days.

10. Modifications to the Service and Terms

We may modify the Service or these Terms at any time. For significant changes, we will notify you by email or through the Service at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

We may also add, modify, or discontinue features at our discretion. If we discontinue a feature you rely on, we will provide reasonable notice.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first. If negotiation fails, disputes will be submitted to binding arbitration or the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
