Terms of Service

Last updated: 7 October 2026

These Terms of Service ("Terms") govern your use of VirtualTourEasy ("VTE", "the Service"), operated by REMARSO LLC, a New Mexico limited liability company, USA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

Our Privacy Policy explains how we collect, use, share, and retain personal information, including data from Google and Facebook. To request removal of your account or personal information, see our data deletion instructions.

1. Account Registration

To use VirtualTourEasy, you must create an account. You agree to:

You may sign up using email/password, Google OAuth, or Facebook OAuth. You must be at least 16 years old to use the Service.

2. Your Licence to Use the Service

Licence grant

Subject to these Terms and payment of any applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to access and use the Service for your own business purposes, including creating, hosting, and publishing virtual tours.

This licence is granted to a single organisation. Accounts, seats, API keys, builder session links, and login credentials may be used only by that organisation's own employees, contractors, and agents acting on its behalf.

Agency and client work — permitted

You may use the Service to produce and deliver virtual tours for your clients, publish those tours under your own branding and custom domain where your plan allows, and charge your clients for that work. This is a normal and fully supported use of the Service, and nothing in this section is intended to restrict it.

Resale and platform use — not permitted

You may not resell, sublicense, rent, lease, or otherwise provide access to the Service to third parties as a product or service of your own. In particular, you may not:

The distinction is what you are selling: producing tours as a service for identified clients is permitted; reselling access to the Service itself is not.

If you would like to embed or resell the Service as part of your own platform, this is available under a separate written reseller or OEM agreement. Contact support@virtualtoureasy.com and we will be glad to discuss it.

Fair use of "unlimited" plans

Where a plan is described as offering unlimited tours, scenes, or similar, "unlimited" means without a fixed numerical cap for normal use by a single organisation. It does not extend to use on behalf of, or resale to, third parties beyond the agency use described above.

We may contact you where your usage is materially inconsistent with single-organisation use — for example, an unusually large number of distinct custom domains, or API volume far in excess of comparable accounts. Where we do, we will tell you what we have observed and give you at least 30 days to resolve it or move to an appropriate plan before we apply any limit. The only exception is usage that threatens the security, stability, or integrity of the platform, which we may act on immediately.

3. Acceptable Use & Prohibited Content

You agree not to use VirtualTourEasy to:

We reserve the right to remove content and suspend accounts that violate these Terms.

Strictly Prohibited Content

The following content is strictly prohibited on VirtualTourEasy and will result in immediate account suspension or permanent ban:

We actively monitor and review content on the platform. Any content flagged as prohibited will be reviewed, and the associated account may be immediately suspended without prior notice. Repeated violations will result in permanent account termination.

User Liability for Content

You are solely responsible and legally liable for all content you upload, create, or publish on VirtualTourEasy. By using the Service, you represent and warrant that:

VirtualTourEasy is a hosting platform and is not liable for user-generated content. We act as a neutral intermediary and will cooperate fully with law enforcement authorities when required.

4. Content Ownership

Your Content

You retain full ownership of all content you upload to VirtualTourEasy, including images, audio, tour configurations, and any other materials. We do not claim ownership of your content.

By uploading content, you grant us a limited, non-exclusive license to host, store, display, and distribute your content as necessary to provide the Service (e.g., serving your published tours to viewers).

AI-Generated Content

When you use our AI features (photo enhancement, 360° generation, scene generation, outpainting, text-to-360°, video), the resulting AI-generated or AI-modified media is yours to use. However:

Lead Data

Data collected through your lead capture forms belongs to you. You are the data controller for any personal data collected from your tour viewers and are responsible for complying with applicable privacy laws (including GDPR) with respect to that data.

5. Plans, Payments, and Billing

Subscription Plans

VirtualTourEasy offers the following plans:

Annual billing is available at a 20% discount. Plan features and limits are described on our pricing page and may be updated from time to time.

Billing

Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Price changes

We may change our prices. For an existing paid subscription, we will give you at least 30 days' notice by email before a price change takes effect, and the new price will apply from your next billing period after that notice. If you do not accept the new price, you may cancel before it takes effect.

Plan Limits

Each plan has specific limits (number of tours, storage, AI credits, team members, and similar). If you exceed your plan's limits, some features become unavailable until you upgrade or reduce your usage.

If a downgrade, cancellation, or expiry leaves you with more published tours than your plan allows, the most recently updated tours within your limit stay published and the remainder are automatically unpublished. Unpublished tours are not deleted, and they are restored automatically if you upgrade again. The same applies to team members above your plan's seat count, whose access is deactivated rather than deleted. You can see the current state of your account at any time in your dashboard.

Refunds

Subscriptions can be cancelled at any time. Upon cancellation, you retain access to paid features until the end of your current billing period. We generally do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@virtualtoureasy.com.

6. API, MCP, and Integrations

Professional and Business plans include access to our REST API and MCP interface. API keys are issued to your organisation. You are responsible for keeping them secret and are liable for all activity performed with them.

Rate limits and fair use

API and MCP access is subject to rate limits, which are published in our API documentation and may change. We will publish any reduction in the documented limit at least 30 days before it takes effect. We may apply lower limits immediately, and without notice, to a key that is generating load which threatens the stability of the Service.

Permitted API use

You may use the API to integrate the Service with your own systems — your CRM, listing platform, or internal tooling — for your organisation's own tours and those of your clients. The resale restrictions in Section 2 apply to the API in full. In particular, the builder session endpoint may be used to give your organisation's own staff access to the builder; it may not be used to give your end-customers self-serve access to the Service.

AI credits

AI features consume credits. Credits included with a plan reset at the start of each billing period and do not roll over. Purchased credits are valid for 12 months from the date of purchase. Credits are consumed when a generation request is accepted by our AI provider, and are refunded automatically if that generation fails. The credit cost of each feature is shown in your dashboard and may be adjusted from time to time.

Suspension for API abuse

We may revoke or suspend an individual API key immediately, and without prior notice, where it is used in breach of these Terms, generates load that threatens the Service, or appears to have been compromised. Where we do so, we will tell you promptly and explain why.

Google and Facebook integrations

Google and Facebook sign-in are optional. Google Street View requires separate authorization to publish and manage photos through the Service. You are responsible for image rights, accurate location information, and compliance with Google's content rules. Google decides whether and when photos appear on Google Maps. Disconnecting an integration does not cancel your VTE subscription or automatically delete your VTE account or photos already published to Google Maps. See our Privacy Policy and data deletion instructions linked above for details.

7. Service Availability

Service availability: Registration and signed-in use are currently unavailable from Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions, reflecting our service-provider restrictions. You must not use the Service where doing so is prohibited by applicable sanctions or export-control laws, on behalf of a prohibited person or entity, or to evade these restrictions. If access is blocked incorrectly, contact support@virtualtoureasy.com. Support and our privacy and deletion information remain available.

We strive to keep VirtualTourEasy available and reliable, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to:

We are not liable for any loss or damage resulting from service interruptions.

8. Team and Collaboration

If you use team features, the account owner (organization admin) is responsible for managing team member access and ensuring all team members comply with these Terms. The account owner is liable for actions taken by team members within the organization.

Team seats are for individuals within your organisation — employees, contractors, or agents acting on its behalf. Seats may not be allocated to your clients or to third parties as a way of giving them access to the Service.

9. Reporting Illegal or Inappropriate Content

If you encounter content on VirtualTourEasy that you believe is illegal, inappropriate, or violates these Terms, you must report it immediately using one of the following methods:

Please include the tour URL, a description of the issue, and any supporting evidence. We will investigate all reports promptly and take appropriate action, which may include content removal, account suspension, or referral to law enforcement.

We are committed to maintaining a safe platform and will act on valid reports within 24 hours.

10. Termination

By You

Subscription cancellation and account deletion are separate actions. To stop renewal, cancel through Billing. To delete your account or provider-derived information, follow our data deletion instructions. Eligible Free-plan organisation owners can use self-service deletion; all users can contact support, including paid-plan users and people who cannot sign in. Export any content you need before confirming deletion. Our Privacy Policy explains retention exceptions and information held independently by third parties.

By Us

We may suspend or terminate your account if you:

We will make reasonable efforts to notify you before termination, except in cases of severe violations. Upon termination, you may request an export of your content within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law:

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to the Service and Terms

We may modify the Service or these Terms at any time. For significant changes, we will notify you by email or through the Service at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

We may also add, modify, or discontinue features at our discretion. If we discontinue a feature you rely on, we will provide reasonable notice.

14. Governing Law

These Terms are governed by New Mexico law, subject to any mandatory protections that apply where you live. Please contact us first so we can try to resolve a dispute. Unresolved disputes may be brought before a court with jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
